特朗普當天在白宮發表講話說，除核心的必要功能，政府將“採取一切合法手段關閉教育部”，並將“儘快關閉它”。

根據美國憲法，所有聯邦機構的設立和解散通常需要透過立法程式獲得國會批准。特朗普若要關閉教育部，必須透過國會立法程式。
在特朗普簽署行政令後，美國國會亞太裔美國人黨團主席孟昭文和教育特別工作組主席馬克·高野發表聯合宣告說，這是一個“非法決定”，國會在面對這一命令時“絕不能放棄權力”。
此前，美國教育部已啟動大規模裁員。美國媒體11日報道，美國教育部當晚起實施大規模裁員計劃，預計裁減4000名員工中的約1300人。
