Interview with Charles B. Rosenberg
Charles (“Chip”) Rosenberg is a partner in the International Dispute Resolution Practice. He is a specialist in public international law and international arbitration, focusing on both investment treaty arbitration and international commercial arbitration. He has significant experience representing clients in ICSID, UNCITRAL, ICC, SCC, NAFTA and ECT arbitrations. Chip also specializes in US and international enforcement of court judgments and arbitral awards.

Mr. Rosenberg, your own path has been notably diverse, from working as an associate in the area of international trade litigation to gaining experience of international arbitration as a clerk to the Hon. Charles N. Bower, from serving as a trusted adviser to taking on professorship, and, ultimately, joining the partnership at Squire Patton Boggs.

1. When and how did you discover your passion for international arbitration?

I started my career as a junior associate practicing international trade litigation at Hogan Lovells in Washington, DC. But I wanted to practice international arbitration. I had discovered international arbitration somewhat late in law school, and I was attracted to it because it seemed to be more “international” than international trade law. For example, as a U.S. lawyer I could represent a Chinese company in an arbitration against a Turkish company which is seated in Geneva and governed by Swiss law!

I therefore made the decision to build up my international arbitration credentials while refining my written and oral advocacy skills at the law firm. I did this by co-authoring articles, attending panel discussions, and enrolling in the American University’s arbitration summer program. This enabled me to demonstrate to Judge Brower that I had both the interest in and knowledge of international arbitration, despite the fact that my day job was practicing international trade litigation.

Judge Brower took a chance on me and invited me to join him in The Hague to serve as his international arbitration law clerk, a position which enabled me to later transition into an international arbitration practice at a law firm.

B. Advice for Aspiring Arbitration Practitioners

You currently represent individuals, corporations, and sovereign governments in complex investment treaty and international commercial arbitrations.

1. For young legal professionals aspiring to build a career in the field of international arbitration, what steps would you recommend them to take in order to maximize their chances of breaking into the field?

2. What can individuals who are interested in arbitration but have no opportunity to practice, such as students or lawyers who are part of other practice groups, do to learn more about arbitration or cultivate an expertise or “feeling” for arbitration?

Law students and lawyers can do a variety of things to learn more about international arbitration. Law students can enroll in an international arbitration course and participate in a moot court competition, such as Jessup or Vis.

I also recommend that law students and lawyers attend panel discussions and conferences which are regularly held in major cities. These events are usually free and a good opportunity to learn about arbitration and meet members of the international arbitration community. In my experience, it also is common for students and lawyers to reach out to international arbitration practitioners for informational interviews to learn more about their practice.

Finally, to start obtaining international arbitration credentials and demonstrate to the community that you have the knowledge of and interest in international arbitration, I recommend publishing an article – which is often easier if you co-author it. For this purpose, a short 2-3 page article published in Kluwer Arbitration Blog or ITA in Review can be just as useful as a longer article published in a U.S. law review!
