This year's Women's Day on March 8 falling on a Saturday has raised questions about whether women will still have the traditional "half-day off".
根據《全國年節及紀念日放假辦法》,部分公民放假的節日及紀念日,有以下4個:
✪ 婦女節(3月8日):婦女放假半天
✪ 青年節(5月4日):14週歲以上青年放假半天
✪ 兒童節(6月1日):不滿14週歲少年兒童放假1天
✪ 中國人民解放軍建軍紀念日(8月1日):現役軍人放假半天
根據《辦法》規定,部分公民放假的假日,如適逢週六、週日,不補假。

因此,撞上週末的婦女節,是沒有補休的。

雖然,“官配半天假”被週末撞沒了,但不少網友分享,收到了公司送來的婦女節愛心福利和假期。



婦女節加班,按休息日加班費計算,根據《勞社廳函〔2000〕18號》檔案規定——
在部分公民放假的節日期間,對參加社會或單位組織慶祝活動和照常工作的職工單位,應支付工資報酬但不支付加班工資。
如果該節日恰逢星期六、星期日,單位安排職工加班工作而不補休的,則應當依法支付休息日的加班工資。

因此,今年婦女節被安排加班但不能補休的,加班費按照休息日加班費計算。

婦女節福利不是法定福利,根據《關於工資總額組成的規定》——
工資總額由計時工資、計件工資、獎金、津貼和補貼、加班加點工資、特殊情況下支付的工資六個部分組成。其中不包含福利費用。
同時,“有關勞動保險和職工福利方面的各項費用”不列入工資總額的範圍。由此可見,用人單位在“婦女節”向女職工發放的福利,是不計入工資總額的。
因此,婦女節福利不是法定福利,除非合同或規章制度中有相關規定、要求。
