USCIS已披露 2026財年首輪 H1B 抽籤結果,無論最終是否中籤,從 H1B 邁向綠卡的歷程,遠比抽籤更需智慧與規劃。為此,我們今天特別邀請到貝特曼的合夥人律師 Eugene,在直播中為大家剖析從 H1B 到綠卡申請過程中常見的誤區 ,以下為本次直播的專題文字整理。
Eugene:Sure, that's a more complex question than it seems. So, in general, the lottery success rate varies year by year regardless of whether you're Chinese or from other countries. It depends on many factors, such as the number of applicants. But in recent years, it has fluctuated approximately from 16% to the low twenties, like in 2021. And for bachelor's degree applicants, the success rate is in a certain range. For master's degree applicants, it's a bit higher, probably ranging from 18% to 23% or 24%. So, specifically for Chinese applicants, these are not official figures. But approximately 73% of the H1B recipients are Indians, as I believe. China ranks second. I think in the past two years, the proportion of Chinese students has been around 14% or so.

Eugene:Like I just mentioned in the previous question, the percentage of success for somebody with a master degree is slightly higher. Yeah, again, the specific numbers vary year by year depending on the total number of people. But on average in the last several years, if you're in the master lottery, maybe about 3 to 4% higher than others. If I may just add one more thing. This actually came up recently. People need to understand also that just because you have a master's degree, it doesn't mean that you should necessarily be enrolled in the master lottery. Because many people have job offers for jobs that are not compatible with their master's degree, but may be compatible with their bachelor's degree. So sometimes they have to weigh the risk of a slightly better H1B lottery chance versus ultimate approval. Okay, so that's important for people to remember.

Eugene:Sure. If you have not finished your F1 program yet, for example, if you're on OPT and you still have some years left, then obviously you can stay by continuing your F1 program if it's not done yet. That's the first way. The second way is that if you're done with your F1 and you've completed your degree, many people choose to stay by going back to school and enrolling in a new degree. Maybe, if you just finished your bachelor's, you can go for a master's; if you just finished your master's, you can go for a PhD or other combinations.
The third way, on a smaller scale and for a shorter period, I should say, is to convert your status to tourism status, basically changing from F status to B status. Okay, that can allow you to stay for at most 1 year because the B visa is limited to one year per se. You need to leave and try to come back later. Right? But you can apply for an extension.
The last way is to apply for a green card, which in today's world really means applying for EB – 5. The reason I say EB – 5 is that if you apply for EB – 5, you can be eligible for a green card immediately without visa wait times. Whereas if you happen to be eligible for EB 1, 2, 3, then you have to wait for approximately five years and you can't stay immediately. So it's not a realistic option.

Eugene:If you get selected in the lottery the next step is to prepare and file the H1B petition. You have 90 days to do that. So it's due by the last days of June. I think it's June 28th or June 29th, something like that. And remember, it's not the person who wins the lottery that files it. It has to be filed by the company. Everything's handled by the company, so they have 90 days to do it.
So if you win the lottery, don't wait too long because it sometimes takes extra time to prepare. So make sure your company is actively working on it, If you get selected.

Eugene:Yeah, if you are in H1B status, if you mean that if you have already gotten selected in the lottery, gotten approved and started working with H1B status, if you get a new job, that's fine. You're allowed to change jobs, but your new employer has to first file a new H1B application for you. You can't just change because you want to. They have to file an amendment for you to change employer. The easy way to say that is to remember that the H1B status is tied to your employer. It's not a general work visa. It's tied to the company that sponsored you.

Eugene:Okay, first of all, there's no such thing as an unemployment period in H1B. The term “unemployment period” is a technical term that refers to OPT. In H1B, there's something different called the grace period. Even though it's similar, it's important to distinguish between them because the rules are totally different. So in H1B, if you either quit your job or you get fired from your job, whatever the situation may be, you have a 60 – day grace period. That means within 60 days from your last working day, you either have to file an application for a new job with a new sponsor or file for a change of status to some other status. But basically you have to do something within 60 days. Yes, after 60 days, you're deemed in violation of status or out of status, I should say.

Eugene:Sure. If you travel out and return using an H1B visa while in H1B status. No matter who you are, what kind of visa you hold, and whenever you travel to the United States on any visa, there is always some level of risk. It's usually quite small, but there's always some level of risk. That is to say that there's no such thing as a 100% guarantee of entry. That doesn't exist. That means that entry into the United States with a visa, as a matter of law, is not something you're entitled to automatically. It's subject to screening by customs, you know. Okay? And anytime you have to go through customs, there's always some level of risk. Now, generally speaking, the risk is indeed very small as I see it. Okay. Yes, generally speaking, the risk is very small. As long as you have been in compliance with all the regulations.
Now, these days, I know from the news about all these stories. A lady on H1B actually just got kicked out and wasn't allowed in recently. That's been in the news last week. You have to keep in mind that in the news, you always hear the bad news. No one ever reports the good news. Right. So, while it may seem scary, it's a very small chance. It's because that's what you typically hear about. But generally, if customs officers have some kind of reason to think that you're inadmissible based on some kind of law, like, you know, if you have a criminal history. If you have ties to some kind of terrorists or organizations that you support, or like in recent times, the people who had problems, that,who had public social media support for terrorist groups, things like that. Okay. But if you're a typical person, it's fine.
